Terms of Service

1. Acceptance

By creating an account or using the Stubsmith service ("Service"), you agree to these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

The Service is operated by Bram Hoven, a sole trader established in the Netherlands and trading as Stubsmith ("Stubsmith", "we", "us").

2. Service description

Stubsmith is a software-as-a-service platform that enables developers to generate privacy-safe API stubs from real traffic. The SDK masks samples at the edge, inside your infrastructure, before transmission; Stubsmith stores masked bodies and field names. No raw value is stored unless you have approved a keep rule for that specific field.

3. Accounts and organizations

Each signup automatically creates an organization. An organization may have one or more members depending on the subscription plan. You are responsible for maintaining the security of your account credentials and for all activity under your account.

3.1 One free workspace per organization

Each legal entity or organization is entitled to one Free-tier workspace. Creating multiple Free-tier workspaces for the same organization to circumvent plan limits is a violation of these Terms and may result in account suspension.

4. Subscription plans and billing

Paid plans are billed in advance on a monthly or annual basis. Prices are displayed including VAT.

4.1 Merchant of record

Payments are handled by Creem (Armitage Labs OÜ, registry code 16977866, Rotermanni 14, Tallinn 10111, Estonia), which acts as the merchant of record and contractual reseller of Stubsmith subscriptions. Creem executes the sale in its own name, calculates and charges the tax applicable to your billing address, remits it to the relevant authorities, and issues your receipt. Your payment details are entered on Creem's checkout and are never received or stored by Stubsmith.

4.2 Renewal and cancellation

Subscriptions renew automatically at the then-current price for the same interval. You may cancel at any time from the Billing page in the dashboard, without contacting us. Cancellation stops the next renewal; your plan stays active until the end of the billing period you have already paid for, after which the organization reverts to the Free plan.

4.3 Refunds

If Stubsmith is not what you expected, email support@stubsmith.dev within 14 days of your first payment on a subscription and we will refund it in full. Consumers in the EU/EEA additionally have the statutory 14-day right of withdrawal, which these Terms do not limit.

Renewal payments are not refundable for the unused remainder of a period, with one exception: if a renewal caught you by surprise, contact us within 7 days of the charge and we will refund it and close the subscription. Refunds are issued by Creem to the original payment method.

5. Data and privacy

Sample payloads are masked by the SDK at the edge before transmission to Stubsmith. Stubsmith stores masked bodies, field names, and structural fingerprints. No raw value is stored unless you have approved a keep rule for that specific field. Retention periods apply to samples as described in the plan documentation. Fingerprints, request types, and generated stubs are retained until you explicitly delete them or close your account.

Your use of the Service is also governed by our Privacy Policy and, where applicable, our Data Processing Agreement.

6. Acceptable use

You agree not to:

• Use the Service to capture or store data that you are not authorized to access.
• Attempt to reverse engineer, decrypt, or access another organization's data.
• Use the Service for any unlawful purpose or in violation of applicable privacy laws.
• Circumvent plan limits through multiple accounts as described in §3.1.
• Introduce malware or attempt to disrupt the Service.

7. Intellectual property

Stubsmith and its technology are owned by Bram Hoven, trading as Stubsmith. Your data (including masked samples, fingerprints, and generated stubs) remains yours. You grant Stubsmith a limited license to store and process your data solely to provide the Service.

8. Disclaimers and limitation of liability

The Service is provided "as is". To the maximum extent permitted by applicable law, Stubsmith disclaims all warranties, express or implied. Stubsmith's total liability to you for any claims arising from these Terms or the Service shall not exceed the amounts you paid in the twelve months preceding the claim.

9. Termination

Either party may terminate the relationship at any time. On termination of any plan, masked sample data is deleted in accordance with the applicable retention and erasure policy. You may export your stubs and fixtures before account closure.

10. Governing law

These Terms are governed by the laws of the Netherlands. Disputes shall be submitted to the competent courts of Amsterdam.

11. Changes to these Terms

We may update these Terms from time to time. We will notify you by email and via the dashboard at least 14 days before material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
